Terms of Service

These Terms govern your access to and use of the FNDER website, platform and related services operated by Fnder (Pty) Ltd.

Effective: 7 August 2026

1. About FNDER

FNDER is a business-finance software platform designed to help users model financial and capital scenarios, assess funding capacity, analyse financial information, prepare funding-related outputs and identify potential capital providers.

2. Acceptance of these Terms

By accessing or using FNDER, you agree to these Terms. If you use FNDER on behalf of a company or other organisation, you confirm that you have authority to act on its behalf.

3. Accounts and workspaces

Certain FNDER functionality requires an account. You are responsible for providing accurate registration information, maintaining the confidentiality of your account credentials and all activity performed through your account.

You must notify us promptly if you reasonably believe that your account has been accessed without authorisation.

4. Your information

You retain ownership of the business information, documents, assumptions and other content that you provide to FNDER.

You grant us the limited rights necessary to process that information for the purpose of operating the platform and providing the services you request.

You are responsible for ensuring that you have the right to upload, use and process information submitted to FNDER.

5. Financial modelling and indicative outputs

FNDER produces estimates, models, scenarios, calculations, assessments and other outputs based on information and assumptions provided by users or derived from available financial information.

These outputs are indicative and may change when assumptions, financial information, market conditions or other inputs change.

6. No financial advice or funding guarantee

FNDER does not provide financial, investment, tax, legal or accounting advice unless expressly agreed otherwise in writing.

Funding-capacity estimates, investor-readiness assessments, capital-route recommendations and similar outputs are decision-support tools and should not be treated as a funding offer, credit approval, investment commitment or guarantee that funding will be obtained.

Users remain responsible for their own business, financial and capital decisions and should obtain appropriate professional advice where necessary.

7. Capital providers

FNDER may display information about lenders, investors, development finance institutions, funds or other capital providers.

Inclusion on the platform does not mean that FNDER endorses, represents or guarantees a capital provider, nor does it mean that a provider will accept a user's application or transaction.

Any funding or investment relationship is subject to the relevant third party's independent assessment, due diligence, terms and approval processes.

8. Acceptable use

You may not use FNDER to violate applicable law, infringe the rights of others, introduce malicious software, interfere with the operation or security of the platform, attempt unauthorised access, or submit information that you are not authorised to use.

9. Intellectual property

FNDER and its software, interface, branding, content, methodologies and related intellectual property are owned by or licensed to Fnder (Pty) Ltd.

These Terms do not transfer ownership of FNDER intellectual property to users.

10. Subscriptions and payments

Certain features may be offered under free, paid or enterprise plans. Pricing, feature availability and usage limits may vary by plan and may change over time.

Where payment is required, the applicable price and billing terms will be presented before purchase or otherwise agreed with the customer.

11. Platform availability

We aim to provide a reliable service but do not guarantee that FNDER will always be available, uninterrupted or error-free.

We may modify, maintain, suspend or discontinue parts of the platform where reasonably necessary, including for security, maintenance or product-development purposes.

12. Third-party services

FNDER may depend on or integrate with third-party technology, payment services, authentication providers, infrastructure or external websites. Those services may be subject to separate terms and policies.

13. Limitation of liability

To the maximum extent permitted by applicable law, FNDER and Fnder (Pty) Ltd will not be liable for indirect, incidental, consequential or special losses arising from use of the platform or reliance on its indicative analyses, models or outputs.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

14. Termination

You may stop using FNDER at any time. We may restrict or terminate access where reasonably necessary to address material breaches of these Terms, unlawful activity, security risks or misuse of the platform.

15. Governing law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections that apply under applicable law.

16. Changes to these Terms

We may update these Terms as the platform, services or applicable requirements change. Material updates will be reflected by changing the effective date above.
